Are Polygraph Results Admissible in Court?

Sometimes but of course like anything admitted in a court it depends on what court and for what purpose. In the federal court, yes but it's up to the discretion of the trial judge and may follow testimony as to the examiner's credentials. The Dallas court of appeals recently allowed polygraph results to support the therapist's testimony in a motion to revoke the probation of a sex offender. Polygraph results are admitted intermittently in many state court systems especially in probation issues and the sexual offender monitoring program. This use of polygraph testing has identified hundreds of victims and crimes that may have never been discovered. Let's get one thing clear.

"The utility of a polygraph examination has proven to be a very successful investigative tool but it is not designed to supplant or act as a prosecutorial piece of evidence that was properly collected and has a solid chain of custody."

In other words folks… we ain't tryin to go to court with a polygraph! When a judge says it's not admissible this time in this case it often has more to do with the long held concept in the American justice system that the jury is the trier of fact and not a polygraph examiner's professional opinion.

The bottom line is that barring any additional information to consider like a video tape for example then a professional polygraph examination is the best available method and process of testing the veracity of a specific statement or fact in question. The results are then used or at least considered in the context of other investigative findings.

Is a Polygraph 100% Accurate?

Off course not! Nothing is 100% accurate, not a bullet, not a mammogram and often other systems like a partial finger print or even DNA can be rightly disputed depending on how the evidence was collected or the subjective opinion of the "expert".

If you need a professional polygraph examination we hope you will consider the retired federal agents and polygraph examiners at www.DallasLieDetectors.com. If you choose to make an appointment with a different firm our best advice is select another former federal agent.
